These Terms govern your use of Flowgento, a service operated by eMarinersApp DBA Flowgento (GSTIN: 21CIJPP8904K1ZY), referred to here as "Flowgento", "we", or "us". By creating an account or using the service you agree to these Terms.
1. Acceptance
By signing up for or using Flowgento you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Service description
Flowgento is a software-as-a-service platform that helps businesses send WhatsApp Business API messages, manage contacts and conversations, and store related media. Features and limits depend on the plan you choose.
3. Account requirements
- You must be at least 18 years old.
- You must be acting on behalf of a registered business or organisation.
- You agree to provide accurate, current account and billing information.
- You are responsible for keeping your credentials secure.
4. Pricing & billing
- Listed prices are in Indian Rupees (INR) and exclude GST (18% added at checkout).
- Paid plans auto-renew at the end of each billing cycle until cancelled.
- You may cancel any time; cancellation takes effect at the end of the cycle.
- Full refund within 7 days of the first paid month. After that, refunds are not provided for partial cycles.
- We may change pricing with at least 30 days' notice; price changes apply at your next renewal.
5. Acceptable use
You agree not to use Flowgento to:
- send unsolicited spam or messages to contacts who have not opted in;
- send bulk unsolicited messages or spam via WhatsApp;
- scrape, harvest, or collect phone numbers without explicit consent;
- bypass or attempt to bypass WhatsApp's opt-in requirements;
- violate Meta's WhatsApp Business Policy or WhatsApp Commerce Policy;
- send messages that contain harassment, hate speech, illegal content, or content prohibited by Meta;
- use the platform for political campaigning or fundraising in violation of Meta's policies;
- impersonate any person or entity;
- send malware, phishing, or fraudulent content;
- scrape, reverse engineer, or attempt to disrupt the service;
- violate any applicable Indian or international law.
Violations may result in immediate account suspension and reporting to Meta.
6. WhatsApp Business Policy
You are responsible for complying with Meta's WhatsApp Business Policy and Commerce Policy. Violations can result in Meta suspending your WhatsApp Business Account independently of Flowgento, and we may be required to disable your access.
7. Suspension & termination
We may suspend or terminate your account if you:
- materially breach these Terms;
- fail to pay outstanding amounts after a reasonable cure period;
- are required to be suspended by Meta or by law.
On termination, you can export your data for 30 days; after that we may delete it.
8. Intellectual property
We retain all rights, title, and interest in Flowgento, including the platform code, design, and trademarks. You retain ownership of your customer data and content you upload.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability under these Terms in any 12-month period is limited to the amounts you paid us in that period. We are not liable for indirect, incidental, or consequential damages.
10. Indemnification
You agree to indemnify and hold Flowgento harmless from claims arising out of your content, your use of the service, or your breach of these Terms.
11. Governing law & jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Berhampur, Odisha, India.
12. Dispute resolution
Parties shall first attempt to resolve disputes informally by good-faith negotiation for 30 days. Unresolved disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Berhampur, Odisha, India.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app and by email at least 14 days before they take effect.
